Terms of Service

These Terms of Service (“Terms”) govern your use of acrdumpster.com (the “Site”) and the dumpster rental and waste management services (“Services”) provided by ACR Dumpsters, LLC (“ACR,” “we,” “our,” or “us”). By using the Site or our Services, you agree to these Terms.

1. Who we are

ACR Dumpsters, LLC is a Michigan limited liability company registered at 15777 W 10 Mile Rd, Ste 300, Southfield, MI 48075.

2. Service description

ACR coordinates dumpster rental and commercial waste management services across the United States. ACR is a service coordinator and broker. We arrange service through independent hauler companies and service operators in each market. ACR is not the owner or operator of the dumpsters, trucks, or disposal facilities used to fulfill your service.

3. Quotes, contracts, and payment

Quotes. Quotes provided by ACR are based on the information you provide and are valid for the period stated in the quote. Quotes may be revised if project details change.

Contracts. Each service order is governed by an individual service contract that incorporates these Terms by reference. The service contract specifies pricing, included tonnage, prohibited items, overage rates, and other service details.

Payment. Payment terms are specified in your service contract. Standard terms are payment in advance for one-off rentals and net 30 days for established commercial accounts. Late payments may incur interest and collection fees as permitted by law.

Surcharges and overages. You agree to pay any surcharges, overage fees, trip fees, or other charges disclosed in your service contract that result from your use of the service, including but not limited to weight overages, prohibited items, blocked access, and extended rental periods.

4. Prohibited items

You agree not to place prohibited items in any dumpster provided through ACR. Prohibited items typically include hazardous waste, paint and solvents, tires, batteries, refrigerators and appliances containing refrigerants, fluorescent bulbs, asbestos, medical waste, and other materials specified in your service contract or by local regulation. The full prohibited items list is provided with each service contract. Placing prohibited items in a dumpster may result in additional charges, refusal of service, and liability for any resulting damages or fines.

5. Cancellation

Before delivery. You may cancel a service order before delivery, subject to a cancellation fee if cancellation occurs within a defined window before the scheduled delivery time. Cancellation terms are specified in your service contract.

After delivery. Once a dumpster has been delivered, no refunds are issued. You remain responsible for the full contracted service amount and any applicable surcharges.

6. Customer responsibilities

You are responsible for:

• Providing accurate service location, project details, and contact information
• Ensuring safe and lawful access for delivery and pickup
• Compliance with all local regulations, including permits and right-of-way requirements where applicable
• Damage to your property or third-party property caused by your placement decisions or improper use
• Containment of materials within the dumpster and ensuring no overloading or unsafe loading

7. Limitation of liability

To the maximum extent permitted by law:

• The Site and Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
• ACR’s total liability for any claim arising out of or related to these Terms or the Services is limited to the amount you paid ACR for the specific service giving rise to the claim.
• ACR is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.
• ACR is not liable for the acts or omissions of independent hauler companies or service operators except to the extent ACR is directly negligent in their selection or coordination.

8. Indemnification

You agree to indemnify, defend, and hold harmless ACR, its affiliates, officers, employees, and agents from any claims, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of:

• Your use of the Services
• Your violation of these Terms
• Your placement of prohibited items in a dumpster
• Your violation of any third-party rights or applicable law
• Damage to property, injury to persons, or fines resulting from your acts or omissions

9. Dispute resolution and arbitration

Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be conducted in Oakland County, Michigan, or another mutually agreed location.

Jury trial waiver. YOU AND ACR EACH WAIVE THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

Governing law. These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles.

Exception for small claims. Either party may bring an individual action in small claims court rather than through arbitration if the claim qualifies.

10. Intellectual property

The Site, including its design, logos, text, graphics, and software, is owned by ACR or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

11. Termination

We may suspend or terminate your access to the Site or Services at any time, with or without notice, for violation of these Terms or for any other reason at our discretion. Upon termination, the provisions of these Terms that by their nature should survive (including limitations of liability, indemnification, and dispute resolution) will continue to apply.

12. Changes to these terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the Site or Services after changes are posted constitutes acceptance of the updated Terms.
